Last Updated: [05/09/2026]

Welcome to MIRAYA.

These Terms & Conditions (“Terms”) govern your access to and use of https://the-miraya.co and any purchase made through the website.

MIRAYA is a fashion and imitation jewellery business operated and owned by Harshvardhan Swarnakar.

By accessing the website, creating an account, placing an order, making a purchase, or otherwise using our services, you agree to these Terms and the other policies applicable to your purchase.

1. ABOUT MIRAYA AND ACCEPTANCE OF THESE TERMS

MIRAYA operates an online fashion and imitation jewellery business.

These Terms apply to the website, products, orders, payments, delivery, returns, exchanges, refunds, gift cards, warranty/re-plating services and other services offered by MIRAYA.

By using the website or placing an order, you confirm that you have read and understood these Terms to the extent reasonably possible and agree to comply with them.

The following policies also form part of the applicable terms of your purchase:

  • Privacy Policy

  • Shipping & Delivery Policy

  • Return, Refund & Exchange Policy

  • Warranty / Free Re-plating Policy

  • Gift Card Terms, where applicable

Where a separate policy contains a specific rule for a particular subject, that policy will apply to that subject.

2. ELIGIBILITY AND CUSTOMER ACCOUNTS

MIRAYA’s services are intended for customers who are legally eligible to use and purchase through the website under applicable law.

Customers may place orders through an available customer account or through guest checkout, where offered.

You are responsible for providing accurate and complete information and for maintaining the security of any account credentials associated with your account.

MIRAYA may restrict or suspend access to an account where reasonably necessary to address fraud, misuse, security risks, unlawful activity or other legitimate concerns.

3. WEBSITE USE

You may use the website only for lawful purposes and in accordance with these Terms.

You must not:

  • use the website for fraudulent, unlawful or abusive purposes;

  • attempt to gain unauthorised access to the website or its systems;

  • interfere with website security or operation;

  • introduce malicious code, malware or other harmful material;

  • scrape, copy or systematically extract website data without permission;

  • impersonate MIRAYA or another person; or

  • use the website in a manner that infringes the rights of MIRAYA or any third party.

MIRAYA may take reasonable steps to restrict access where misuse or unlawful activity is suspected.

4. PRODUCTS AND PRODUCT INFORMATION

MIRAYA currently sells fashion and imitation jewellery.

Products may be made using materials including brass, copper and other metal alloys and may contain gold, silver, rhodium or other coatings/platings depending on the individual product.

The exact material and plating information applicable to a product will be provided on the relevant product page where applicable.

References to gold-plated, silver-plated, rhodium-plated or similar finishes do not mean that the product is made of solid gold, solid silver or another precious metal unless expressly stated.

Product photographs are intended to provide a reasonable representation of the product. Minor variations in colour, finish, texture, size or appearance may occur due to photography, lighting, display settings and manufacturing characteristics.

5. PRICES, TAXES AND PRODUCT AVAILABILITY

Prices displayed on the website are stated in Indian Rupees (INR) unless otherwise specified.

Product prices, availability, descriptions and offers may change from time to time.

As of the applicable date of these Terms, MIRAYA is not registered under GST and does not represent any displayed price as including a separate GST charge unless such tax is lawfully applicable and MIRAYA is entitled or required to collect it.

If an obvious pricing, product-description, technical or availability error occurs, MIRAYA may correct the error and, where necessary, cancel or reject the affected order. If payment has already been received for an order that MIRAYA cannot fulfil for such a reason, the applicable amount will be refunded.

6. PAYMENT METHODS

MIRAYA may accept payment through methods displayed at checkout, which may include:

  • UPI

  • Credit and debit cards

  • Net banking

  • Cash on Delivery (COD)

Payments may be processed through third-party payment service providers.

An order is not considered successfully paid until the applicable payment status is confirmed.

If an amount appears to have been debited but an order is not confirmed, customers should first verify the order/payment status and contact MIRAYA rather than repeatedly submitting the same payment.

MIRAYA does not request customers to share confidential authentication credentials such as UPI PINs, card PINs, banking passwords or OTPs through customer-support channels.

7. GIFT CARDS

MIRAYA may occasionally issue or sell gift cards.

Unless a particular gift card or promotional communication states otherwise, a gift card will normally be valid for 30 days from the date of issue.

A special promotional gift card may have a different validity period, which will be stated with that offer.

Gift card rules include:

  • Only one gift card may be used per order.

  • A gift card can be used only when the eligible order value is at least equal to the gift card’s face value.

  • For example, a ₹200 gift card cannot be used against a ₹199 eligible order, but may be used against a ₹200 or higher eligible order.

  • If a ₹200 gift card is used against a ₹500 eligible order, ₹200 may be paid using the gift card and the remaining ₹300 may be paid through another available payment method.

  • Gift cards are non-transferable.

  • Gift cards cannot be exchanged for cash.

  • Gift card balances are not refundable.

  • Any unused balance expires when the gift card expires.

  • No cash, credit or other compensation will be provided for an expired gift card balance.

  •

Unless specifically announced otherwise, MIRAYA does not operate a separate voucher programme.

8. ORDERS AND ORDER ACCEPTANCE

Placing an order through the website constitutes a request to purchase the selected products.

MIRAYA may accept or reject an order based on product availability, payment status, pricing or description errors, technical issues, suspected fraud, unlawful activity or other legitimate circumstances.

An order acknowledgement or payment confirmation does not necessarily constitute final acceptance where additional verification is reasonably required.

MIRAYA may contact the customer to verify order details, payment information, shipping information or COD orders.

Customers are responsible for reviewing order details before completing checkout.

9. CANCELLATION AND REFUSAL OF DELIVERY

Customers may request cancellation before the order is dispatched.

Once an order has been dispatched, normal customer-initiated cancellation is not available, except where cancellation or another remedy is required or permitted under applicable law or expressly accepted by MIRAYA.

MIRAYA may cancel or reject an order where reasonably necessary because of circumstances such as:

  • stock unavailability;

  • obvious pricing or product-description errors;

  • payment failure;

  • suspected fraudulent or abusive activity;

  • inability to service the order;

  • legal or regulatory requirements; or

  • other legitimate circumstances affecting fulfilment.

  •

Doorstep refusal

After dispatch, a customer may refuse to accept a delivery at the doorstep.

For a prepaid order that is refused after dispatch, the order may be returned to MIRAYA and the applicable reasonable return/RTO logistics cost may be deducted from the refundable amount, to the extent permitted by applicable law and disclosed to the customer.

For a COD order, no payment refund arises where the customer refuses delivery; MIRAYA may bear the applicable RTO cost.

Repeated or intentional refusal of COD orders may result in COD being restricted or disabled for future orders.

10. CASH ON DELIVERY

COD may be available only in serviceable locations and may be subject to verification.

MIRAYA may require additional verification or advance payment for certain high-value, unusual, suspicious or otherwise higher-risk COD orders.

MIRAYA may restrict or disable COD where there is a history of repeated refusal, non-acceptance, fraudulent activity or other misuse.

11. SHIPPING AND DELIVERY

MIRAYA currently offers sales and delivery within India only.

Orders are generally processed and dispatched according to the timelines stated on the website or at checkout. Delivery timelines are estimates and may vary depending on location, courier availability, weather, operational conditions and other circumstances.

Customers are responsible for providing a correct and complete delivery address and phone number.

Delivery may be affected by:

  • incorrect or incomplete address details;

  • inability to contact the recipient;

  • repeated failed delivery attempts;

  • refusal or non-acceptance;

  • courier restrictions;

  • operational delays; or

  • events beyond MIRAYA’s reasonable control.

  •

Tracking information may be provided where available.

For detailed shipping terms, customers should refer to the Shipping & Delivery Policy.

12. RETURNS

MIRAYA generally accepts eligible returns within 5 calendar days from the date of delivery.

Change-of-mind returns are allowed subject to the applicable return conditions.

Products must generally be returned unused and in substantially the same condition in which they were received, together with applicable original packaging and accompanying items where required.

Sale, clearance and special promotional products remain returnable unless a particular offer expressly states otherwise and such restriction is lawful.

For valid returns accepted under the applicable policy, MIRAYA will bear the applicable reverse-shipping cost.

Detailed return requirements and exclusions are set out in the Return, Refund & Exchange Policy.

13. EXCHANGES

Eligible products may be exchanged in accordance with the Return, Refund & Exchange Policy.

Exchange availability depends on stock and product eligibility.

Where an exchange involves a higher-value product, the applicable difference may be payable by the customer.

Where an exchange involves a lower-value product, no automatic cash refund of the difference will be provided unless otherwise required by applicable law or expressly approved by MIRAYA.

14. REFUNDS

Where a refund is approved, MIRAYA will generally process the refund to the original payment method or through another appropriate method where necessary.

For prepaid orders, refunds will generally be processed within 5–7 business days after approval, subject to the processing time of the relevant bank, payment provider or financial institution.

COD refunds, where applicable, may require the customer to provide appropriate bank or payment details.

Refunds relating to returned products will normally be processed after receipt and inspection of the returned product.

Where a prepaid order is refused after dispatch, applicable reasonable RTO/return logistics costs may be deducted from the refundable amount to the extent permitted by law.

Mandatory statutory refund rights, where applicable, remain unaffected.

15. DAMAGED, WRONG OR DEFECTIVE PRODUCTS

Customers should contact MIRAYA as soon as possible if they receive a product that appears damaged, defective, incomplete or different from the product ordered.

For damage, wrong-product or similar delivery claims, MIRAYA may require photographs, parcel images, product images and an unboxing video recorded during opening of the delivered parcel.

Such evidence may be required within 24 hours of delivery for the relevant claim to be investigated.

MIRAYA may review the evidence, delivery records, packaging condition and other relevant information before determining an appropriate resolution.

This unboxing-video requirement applies to relevant damaged, wrong, defective or incomplete-product claims and does not replace or alter the separate lifetime free-replating terms.

16. LIFETIME FREE RE-PLATING

MIRAYA may provide lifetime free re-plating for eligible jewellery purchased directly from MIRAYA, subject to the applicable product and warranty conditions.

Under this service:

  • the applicable re-plating labour/service charge is free;

  • the customer is responsible for shipping the jewellery to and from MIRAYA where shipping is required;

  • physical damage, breakage, bending, dents, deformation and similar physical damage are not covered;

  • normal wear and tear is not automatically treated as a plating defect;

  • misuse, accident, improper storage, excessive friction or abrasion, chemical exposure and other excluded causes may make the product ineligible;

  • the jewellery may be inspected before re-plating is approved;

  • re-plating does not repair structural or physical damage unless MIRAYA separately agrees to provide such repair on applicable terms.

The detailed Warranty / Free Re-plating Policy will govern eligibility, exclusions and the claim process.

17. PROMOTIONS, DISCOUNTS AND SPECIAL OFFERS

MIRAYA may run promotional offers, discounts, limited-time campaigns, contests or other special schemes.

Each offer may have its own eligibility criteria, validity period, redemption conditions or restrictions.

Unless expressly stated otherwise, promotional benefits may not be combined or exchanged for cash.

MIRAYA may correct obvious promotional or technical errors and may take reasonable steps against fraudulent or abusive use of offers.

18. REVIEWS AND CUSTOMER CONTENT

Customers may be permitted to submit reviews, ratings, photographs or other content.

Reviews and submitted content should be genuine, relevant and lawful.

Customers must not submit content that is fraudulent, defamatory, abusive, unlawful, misleading, infringing, threatening or intended to manipulate ratings or promotions.

MIRAYA may moderate, reject, remove or restrict content that violates these Terms or applicable law.

By submitting content, you grant MIRAYA a non-exclusive, royalty-free permission to use, reproduce, display and publish that content for legitimate business, marketing or website purposes, subject to applicable law.

19. INTELLECTUAL PROPERTY AND BRAND PROTECTION

MIRAYA and its licensors retain rights in the MIRAYA name, logo, branding, product photographs, graphics, designs, website content, written descriptions and other intellectual proprty used on the website, except where third-party rights apply.

You may access the website for personal and lawful shopping purposes.

You must not reproduce, copy, modify, publish, distribute, commercially exploit or create derivative works from MIRAYA content without prior permission, except where permitted by applicable law.

You must not represent yourself as MIRAYA, an authorised representative, employee or official partner without actual authorisation.

Unauthorised commercial resale or use of MIRAYA branding may not be undertaken without permission.

20. FRAUD, ABUSE AND MISUSE

MIRAYA may investigate suspected fraud, misuse or abuse involving orders, payments, COD, refunds, returns, exchanges, warranty claims, gift cards, promotional offers, accounts or website access.

Prohibited conduct includes, without limitation:

  • false or fraudulent orders;

  • payment fraud;

  • chargeback or payment-dispute abuse;

  • repeated COD refusal or misuse;

  • fraudulent return or refund claims;

  • manipulation of reviews;

  • coupon or gift-card abuse;

  • impersonation;

  • account abuse;

  • unauthorised resale or brand representation; or

  • intentional interference with MIRAYA’s systems or services.

Where reasonably necessary and legally permitted, MIRAYA may cancel affected orders, restrict payment methods, suspend accounts, restrict website access or take other appropriate action.

21. THIRD-PARTY SERVICES

MIRAYA may use third-party services including website technology providers, payment processors, courier/logistics providers, communication services, analytics tools and security services.

The availability and operation of third-party services may be outside MIRAYA’s direct control.

Your use of a third-party service may also be subject to that provider’s own terms and privacy policy.

MIRAYA is not responsible for matters caused solely by a third party to the extent not attributable to MIRAYA, subject always to applicable law.

22. PRIVACY

MIRAYA’s collection and use of personal information is governed by the Privacy Policy.

By using the website or providing information, you acknowledge the Privacy Policy and any notices or consent mechanisms applicable to the particular processing activity.

MIRAYA will handle personal information in accordance with applicable privacy and data-protection requirements.

23. WEBSITE AVAILABILITY AND TECHNICAL ISSUES

MIRAYA aims to keep the website available and functional but does not guarantee uninterrupted or error-free operation.

The website may occasionally be unavailable due to maintenance, technical problems, third-party outages, security issues, network interruptions or circumstances beyond MIRAYA’s reasonable control.

MIRAYA may modify, suspend or discontinue parts of the website or services where reasonably necessary.

24. DISCLAIMERS AND LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, MIRAYA does not guarantee that the website will always be uninterrupted, completely error-free or continuously available.

Product appearance, plating durability and other product characteristics may vary according to usage, care, environmental exposure and normal wear.

Nothing in these Terms is intended to exclude or restrict liability that cannot lawfully be excluded or restricted, including mandatory consumer rights or other liability that applicable law does not permit MIRAYA to limit.

To the extent legally permitted, MIRAYA will not be responsible for losses arising solely from events or circumstances outside its reasonable control or from third-party systems that are not under MIRAYA’s control.

25. CUSTOMER RESPONSIBILITY AND INDEMNITY

You are responsible for your unlawful, fraudulent, intentionally abusive or wilfully harmful use of the website and services.

To the extent permitted by applicable law, you may be responsible for direct losses or reasonable costs suffered by MIRAYA as a result of your unlawful conduct, fraud, intentional misuse, infringement of third-party rights or material violation of these Terms.

This provision does not require a customer to indemnify MIRAYA for MIRAYA’s own unlawful conduct or liability that cannot legally be transferred to the customer.

26. CHANGES TO THESE TERMS

MIRAYA may update these Terms from time to time to reflect changes in products, services, technology, business operations or applicable legal requirements.

The latest version will be published on the website with an updated “Last Updated” date.

Changes will generally apply prospectively and will not unlawfully remove rights or obligations that have already accrued.

The Terms applicable to an order will be determined in accordance with the version and transaction terms applicable at the relevant time.

27. SUSPENSION, TERMINATION AND ACCESS RESTRICTIONS

MIRAYA may suspend or restrict an account or website access where reasonably necessary because of fraud, unlawful activity, security concerns, misuse, abuse or material violation of these Terms.

A customer may stop using the website or close an available account, subject to any outstanding transactions and MIRAYA’s legal or record-retention obligations.

Clauses concerning payments, intellectual property, privacy, liability, disputes, fraud, indemnity and other provisions that by their nature should continue will survive termination to the extent applicable.

28. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of India, subject to applicable consumer-protection and other mandatory laws.

Customers are encouraged to contact MIRAYA first so that genuine complaints or disputes may be reviewed and resolved in good faith.
